Williams v. Overton

Jones v. Bock

The Jerome N. Frank Legal Services Organization (LSO) has joined other prisoners' rights organizations, including the ACLU National Prison Project (NPP), in filing an amicus brief in the consolidated cases of Jones v. Bock and Williams v. Overton in the United States Supreme Court.

These cases will decide a number of important procedural issues under the Prison Litigation Reform Act (PLRA), including: 1) whether the PLRA encompasses a "total exhaustion" rule; 2) whether the PLRA requires an inmate to name all defendants in administrative grievances in order to preserve the right to sue them in court; and 3) who bears the burden of pleading and demonstrating exhaustion.

The brief discusses inmate grievance policies nationwide, as well as forms for inmate grievances from a number of jurisdictions. These materials were contributed by numerous prisoners' rights organizations, including LSO and NPP.
