Is Health Care Reform Constitutional?

Missouri Lt. Gov. Kinder and Prof. Balkin will debate whether the Patient Protection and Affordable Care Act (P.L. 111-148) exceeds the federal government's powers under the Constitution's Commerce Clause and Taxing Power. Lt. Gov. Kinder has filed a federal suit challenging the Act's constitutionality; in a separate suit challenging the Act, Prof. Balkin has filed an amicus brief arguing that the law is constitutional.
