New Views of Originalism

In a debate on the proper methods of originalism, Professors John McGinnis of Northwestern and Jack Balkin of Yale covered the history of originalist thought and teased out their approaches to constitutional interpretation. Professor McGinnis outlined a theory of original methods and original intent justified by the idea of supermajoritarian approval, while Professor Balkin sought to critique that theory.
