The Right of the People to Keep and Bear Arms: Does the Second Amendment Confer an Individual or Collective Right?
Robert Levy successfully challenged the D.C. gun ban in the D.C. Circuit as co-counsel for the plaintiffs in Parker v. District of Columbia. A two-judge majority overturned the gun ban on Second Amendment grounds, and the case is likely headed to the Supreme Court. Dennis Henigan, legal director of the Brady Campaign to Prevent Gun Violence objects to the individual right reading, and believes the Second Amendment only protects a collective right tied to an 18th century state interest in a well regulated militia.
